Official Terms and Conditions.
A) By submitting an entry, Submitter warrants and represents that: (i) he/she is the sole and exclusive owner of the copyrights to the video submission, and has obtained a release from all persons appearing in the video, and from all owners of property appearing in the video submitted for consideration; and (ii) the video, or portions thereof, have not been entered in any previous competition or won any previous awards or competitions and is not subject to any lien or encumbrance; and (iii) Submitter has the full and exclusive right, power and authority to submit the video entry, and to grant Sponsor the right to present the submission to the public, without further compensation; and (iv) no rights in the submission have been previously granted to any other person, firm, corporation, or entity.
B) Sponsor reserves the right to disqualify any submission at any time in the event Sponsor determines, in its sole discretion, that the submission is offensive, inappropriate, not in keeping with Sponsor's image, or that an Entrant has not otherwise complied with these Official Terms and Conditions.
C) If the submission contains any material or elements that are not owned by the Submitter and/or that are subject to the rights of third parties, the Entrant is responsible for obtaining, prior to submission of the video, any and all releases and consents necessary to permit the use and exhibition of the submission by Sponsor. This includes, but is not limited to, music and images protected by copyright, trademark, patent, trade secret, right of privacy, right of publicity, and any other third party rights.
D) By submitting an entry and in consideration of the opportunity to win the cash prize described herein which Submitter acknowledges is good and valuable consideration, Submitter confirms to the Sponsor their assigned right to make copies of the work of authorship, the right to make derivative works based on the work of authorship by editing, adapting or altering in any way the original submission, the right to distribute and sell copies of the work of authorship, and the right to publicly perform and publicly display the work of authorship in the United States and throughout the world including use on the Internet or in any other manner of Sponsor's choice, without attribution or further compensation. Use of a submission by Sponsor does not suggest in any way that the Submitter is a winner.
E) By claiming the winning cash prize, Submitter agrees that Sponsor and its officers, employees, shareholders, affiliates, agents, and advertising and promotional agencies have no liability whatsoever for any injuries, losses, or damages of any kind related to participation in this Promotion, or from acceptance or use/misuse of any prize offered.
G) Acceptance of the winning prize shall constitute Submitter's and Contestant's agreement that Sponsor or its agent(s) may use and/or display their respective name(s), address (city, state only), likeness, biographical information, video entry (and content) and/or prize information, without limitation, for promotional purposes, without further consideration, except where prohibited by law.
H) All taxes on prizes (if applicable) are the sole responsibility of the winners.
I) Prizes are not transferable or assignable, except to a surviving spouse, or at the sole discretion of Sponsor.
J) Sponsor reserves the right, in its sole discretion to cancel, terminate or suspend this Contest for any reason, including if: (a) viruses, bugs, unauthorized human intervention, fraud, technical failure or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest; or (b) earthquake, flood, fire, storm or other natural disaster, act of God, labor controversy or threat thereof, civil disturbance or commotion, terrorism, disruption of the public markets, war or armed conflict (whether or not officially declared). In such event, the prize-winners will be determined by the Sponsor, using the judging criteria above, in Paragraph #5, from all eligible entries received up to the time of such cancellation, termination or suspension.
K) Disputes: Except where prohibited by law, all disputes concerning this promotion will be governed by and construed in accordance with the laws, rules and regulations of the state of Nevada without regard to its choice of laws or conflict of laws provisions.
L) To be eligible for the cash prize, submitter must be at least 18 years of age at the time of entry and must be a legal US citizen unless participant submits written consent from a parent/guardian. Contact us for a release form.
M) To be eligible for the cash prize, submitter must include all information as requested in the To Submit Video section of the Video Contest Rules and Information as posted on the Sponsor's website including Submitters First and Last Name, Phone Number, Email Address, the attachment of their video in the approved format and the Video Release Agreement. By including the Video Release Agreement in the Submitter's email to the Sponsor, the Submitter has acknowledged and agreed to the terms and conditions in said Agreement.
N) To be eligible for the cash prize, videos must be at least 15 seconds in length and no more than 20 seconds in length.
O) Submitters may submit up to five (5) videos. However, each participant is only eligible for one (1) cash prize. For example, if a participant submits multiple videos and two of them are selected for first and second place, the second place video will be dropped and the participant will receive the first place price.
P) Disclaimer. Sponsor reserves the right in its sole discretion to accept or reject entries that do not comply with this format, time and length limitations or entries that contain offensive content.
Q) Voting.
Contest Submission Begins - Wednesday, September 1st, 2010 12:01 a.m.
Contest Submission Ends - Friday, October 30th, 2010 - 5:00 p.m.
Eligibility Check - Week of November 1st-5th, 2010
(We will send back videos that do not meet requirements. Participants will have until Friday, November 5th, 2010 to send back corrected videos to be eligible for the Contest ) All videos will be posted to RenoTahoeJobs.com's YouTube Channel (http://www.youtube.com/user/RenoTahoeJobs)
Voting Begins - Monday, November 8th, 2010 - 12:01 p.m.
Voting Ends - Friday, November 19th, 2010 - 5:00 p.m.
Winner is notified - Monday, November 22nd, 2010
R) Submitter acknowledges that they are competing with submitters in other markets including job boards owned by Workin.com.
S) Workin.com MUST receive at least three eligible video submissions in order for winners to be chosen and cash prizes given away
T) Workin.com reserves the right at any time with or without notice to change the terms and conditions of this Contest at our sole discretion including any all dates and times.
U) By entering this contest, I hereby grant Workin.com, and its legal representatives and assigns, the absolute right and permission to copyright, in Workin.com name or otherwise, and use, reuse, publish and republish photograph portraits, pictures, video and/or sound recordings of my likeness and voice, including those in which I and all other individuals in my video may be included in whole or in part, in composite or distorted character form, without restriction as to changes and alterations in conjunction with my own or a fictitious name, or reproductions thereof in color otherwise, made through any medium at Workin.com studios or elsewhere, and in any and all media now or hereafter known for illustration, promotion, art, advertising, trade or any other purpose whatsoever. I also consent to use of any printed matter in conjunction therewith. I hereby waive any right that I may have to inspect or approve the finished product in the advertising copy or other matter that may be used in connection therewith or the use to which it may be applied.
Video Release Agreement.
By entering Workin.com's Video Contest I give Workin.com permission for my video submitted for the Workin.com Video Contest to be used solely for the purposes of Workin.com promotional material and publications and waive any rights of compensation or ownership thereto. I acknowledge that my video contains my own creative concept and has not been plagiarized in any way.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THE WEBSITE ASSOCIATED WITH THIS PROMOTION, OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
